论我国劳动合同中的经济赔偿金制度

摘    要:我国的劳动关系逐步实现了市场化,劳动合同的订立和解除成了社会生活中频繁发生的现象。劳动合同解除案件中最常见的是用人单位与劳动者之间支付损害赔偿金的问题。根据现行法律规范,我国劳动合同解除的经济赔偿金既有补偿性赔偿金也有惩罚性赔偿金。劳动合同中的主体在承担赔偿责任时,基于保护劳动者权益的立法宗旨,在补偿性赔偿金和惩罚性赔偿金的适用主体、范围与条件上都有许多不同,从而形成了具有鲜明特色的劳动合同解除经济赔偿制度。
