| 摘 要： | 《物权法》明确规定当事人可以通过仲裁途径解决物权纠纷，同时也规定仲裁委员会的法律文书能够产生不动产物权设立、变更、转让和消灭的效力。物权受到侵害的，当事人可以行使物权确认请求权、排除妨害请求权、消除危险请求权、返还原物请求权、恢复原状请求权和损害赔偿请求权，《物权法》已经开始施行，但是仲裁解决物权纠纷所面临的困难是亟需解决和认真对待的问题。

| Abstract: | Property Law explicitly provides that the parties can solve the disputes via arbitration, in the meantime it also stipulates that the legal instrument by arbitration committee can produce the effectiveness of real property establishment, alteration, transfer and elimination. When the property right is infringed, the parties may exercise the right to confirm the claim, the right of eliminating the interference claim, the right of eliminating the risk claim, the right of returning the original claim and the right of resti- tution and damages claim. Property Law has been put into force, all the difficulties of arbitration to resolve property disputes faced are the problems crying for urgent solution and serious treatment. |
