| 摘 要： | 知识产权属于私权的范畴,刑法对知识产权的保护既要体现知识产权的公共利益属性,也应体现知识产权的私权属性。我国刑法对知识产权犯罪规定了七个罪名,涉及著作权、专利权、商标权、商业秘密权。无论从知识产权的范围考察,还是从其涉及到的权利考察,现有罪名均不能全面覆盖实践中发生的严重侵犯知识产权的行为。因此,应在刑法典中增设非法出租侵权复制品罪、非法实施他人专利罪、反向假冒注册商标罪、侵犯集成电路布图设计罪、侵犯植物新品种罪,以完善我国知识产权犯罪的罪名体系。

| Abstract: | Intellectual property rights belong to the category of private rights.Not only the protection of criminal law for intellectual property rights should embody public interest,but also should embody private interest.Criminal law provides seven accusations on intellectual property rights,they related to copyright,patent,trademark and trade secret.Whether the investigation is from the scope of intellectual property rights or from the rights involved,charges are not fully covered by the existing practice of grave violations of intellectual property rights.Therefore,some new crimes should be added to the penal code,such as ： the crime of illegal rental of infringing copies,the crime of illegal use of patent,the crime of reverse counterfeit registered trademark,the crime of infringement of layout-design of integrated circuits,the crime of infringement of the new plant variety,thus to improve the accusation system of intellectual property crime. |
