| 摘 要： | 2008年9月，北京市高级人民法院（北京高院）在对专利复审委员会（简称“复审委”）的专利有效性决定进行司法审查时，否定了复审委作出的给药剂量等给药特微对瑞士型用途权利要求新颖性没有限定作用的行政审查意见，而复审委的审查意见与国家知识产权局（简称“国知局”）《审查指南》（2006）中的具体规定是一致的。

| Abstract: | In September 2008, the Beijing Higher People＇s Court, upon reviewing a patent validity decision made by the Patent Reexamination Board （PRB）, overruled the PRB＇s view that drug administration features, overruled, did not limit or restrict the novelty of a Swiss-type use claim. However, the PRB＇s view conformed to the specific provisions of the State Intellectual Property Office＇s （SIPO） Guidelines for Examination as of 2006. |
