| 摘 要： | 本文阐述了善意取得的起源,比较分析了各国对善意取得的规定及应用,阐述了不动产善意取得理论以及存在的基础和意义。认为不动产善意取得制度有利于充分发挥物的经济效用,有利于维护市场交易的正常秩序,是现代立法的倾向。
