| 摘 要： | 现代西方主要国家的检察制度在长期的历史演变中,通过担任政府法律顾问,提供法律咨询的形式来实现维护经济秩序的目的,从而影响政府在经济管理和调控方面的政策措施,最终对经济秩序起到积极维护的作用。这些国家的检察机关对市场经济秩序的维护是一种有限维护,而不是全面参与;检察机关一般都具有对重大经济犯罪案件和职务犯罪案件自行侦查或指挥侦查的职权,从而扩大了检察机关维护市场经济秩序的方式和途径;检察官具有较强的自由裁量权,有利于提高检察机关维护市场经济秩序的效率;检察机关组织机构具有较高的同一性和独立性,在维护市场经济秩序方面有利于防止外来干涉,打破地方保护,提高检察的公正性。研究和借鉴这些国家的检察机关维护市场经济秩序实践中的这些特点,对更好地发挥我国检察机关维护市场经济秩序的作用具有重要的启示和借鉴意义。

| Abstract: | In the long historic evolution, the procuratorial system of contemporary main western countries realizes its purpose of maintaining economic order by holding the office of government law advisor. In this way, government policies and measures in the respect of economic management and control is influenced, and ultimately takes an active role in the maintaining of economic order. The procuratorial departments of these countries have a limited maintenance to market economic order rather than a comprehensive participation. The procuratorial departments have the power to reconnoiter significant economic crimes and position crimes, thus enriching the modes and approaches of the procuratorial departments in maintaining the economic order. Procurators have bigger freedom of punishment determination, which is beneficial to the efficiency improvement, as well as to prevent outside intervention, to break local protection, to improve the impartiality of investigation. Studying and referring to the above mentioned features have important revelation and reference connotations for a better operation of our procuratorial departments in maintaining economic order. |
