我国劳动争议处理法的历史与现实

摘    要:在我国,劳动争议处理立法肇始于20世纪初的民国时期。其中,解决劳动争议的方式,主要是调解和仲裁。劳动争议处理不仅注重调解和仲裁,而且仲裁往往为诉讼的前置程序。此结论可从我国制定的《劳动争议调解仲裁法》名称本身得以证实。为此,本文就我国劳动争议程序法的演进进行分析,以探求其发展规律。

Abstract:Legislature of labor dispute settlement began the period of the Republic of China at the begining twenty century in our country.And the main modes of settling labor dispute are conciliation and arbitration.The settling labor disputes are not only focus on conciliation and arbitration,but also arbitration is the precedent procedure of litigation.This result can be justified by conciliation and arbitration of labor dispute law of china.Therefore,this article analyses history and present of labor dispute procedural law in our country in order to research its development law.
