| 摘 要： | 期待可能性理论在德日等大陆法系国家受到相当程度的重视,在立法、司法和刑法理论中得到广泛的认可和应用。期待可能性能在防卫社会与保障人权的价值取向中求得平衡,防止国家刑罚权的滥用,对人类普遍脆弱的人性倾注同情,协调人情与法律的紧张关系。借鉴国外期待可能性理论,对于发展与完善我国刑法理论,解决其中一些理论困惑和冲突,有着积极的重要意义。

| Abstract: | Importance has been attached to the t heory of possibility of expectation by civil-law system countries,such as Germany,Japan,etc.This theory has also been w idely adopted and applied in legislation,judicature and penal c ode theories.Possibility of expectation is able to keep balance be-tween defending the society and protecting human rights,prevent a count ry' s criminal penalty from being abused,show its sympathy for f railty of humanism,and harmonize th e conflict between law and human relationship.As a conclusion,the article points out that,to abso rb foreign countries' theory of possibility of expectation would be of great value for developing and perfecting Chinese criminal law theory,as well as resolving puzzles and conflicts among it. |
