| 摘 要： | 倾销同产业损害之间的因果关系是实施反倾销措施的必要条件之一。然在因果关系认定标准上，现有的国际反倾销规则并不明确。若解释为一般原因标准，则过于宽松，容易导致反倾销泛滥盛行，而表征为主要原因标准，又失之过严，难为各成员方所遵守。因此，从反倾销的贸易保护功能及WTO贸易自由化宗旨协调出发，比较现实的是将WTO《反倾销协议》中的因果关系定位为重要原因标准。为维护自身利益和推进多边贸易自由化，我国应坚决反对一般原因标准，力主重要原因标准。

| Abstract: | The causation between the dumping and industry injury constitutes one of the prerequisite to implementing antidumping tax. But in this field of the causation standards, the WTO Antidumping Agreement＇s stipulation is so ambiguous. If explained as the Contributory Cause Standard, it easily leads to the abuse of antidumping because of its loose requirement ; but if expressed as the Principal Cause Standard, it is difficultly obeyed by the memberships of WTO. So it is suitable to regard the WTO Antidumping Agreement＇s causation as the Important Cause Standard and to harmonize the conflict between the antidumping and liberal trade policy. To safeguard the interest of our country and promote the trilateral trade liberalization, we should oppose the Contributory Cause Standard and advocate the Important Cause Standard. |
