| 摘 要： | 随着我国加入WTO，中国经济与世界经济体系相融合，中国涉外的经济贸易纠纷也相应增加，解决这些纠纷的方式之一仲裁，其第一性原则即为“意思自治原则”。文章研究了“意思自治”的历史发展及在国际商事纠纷中的作用，得出“意思自治原则”指导下的国际商事仲裁其价值取向为公平基础上的效益优先的结论，从而为我国仲裁立法中扩大意思自治的运用提供了理论依据。

| Abstract: | With the China＇s entry into the WTO, the further integration of economy between world and China is expected to happen. At the same time, the number of trade disputes between the Chinese and foreign parties will correspondingly increase. One of the solutions about it is arbitration -of which principle is the prin- ciple party autonomy. According to the research on party autonomy＇s historical development and its functions in international trading disputes under the directions Party Autonomy, the author of the passage reaches a conclu- sion that the value orientation of international commercial arbitration is benefit first on the basis of justice, in such way, it provides the theoretical basis for the usage of expanding party autonomy in our counties arbitra- tion, legislation＇s. |
