| 摘 要： | 谈判理论认为自愿合作是实现效率的最佳途径，谈判的根本目标是实现效率，因此，谈判理论在法经济学中得到了广泛应用。谈判理论以效率原则为基础，对财产法、合同法、侵权法均提出了自己的解释。但在实际应用中，谈判理论受到了诸多因素的阻碍，需要克服。

| Abstract: | Negotiation theory believes that voluntary cooperation is the best way to achieve efficiency, and also the fundamental goal of negotiation. That＇s why negotiation theory has been widely used in Law and Economics. Negotiation theory interprets property law, contract law, and tort law, based on the principle of efficiency. However, negotiation theory has to overcome some obstacles in practical applications. |
