| 摘 要： | 受教育权是公民的基本权利，包括平等的受教育机会。在义务教育阶段，平等的受教育机会不仅体现在拥有受教育机会的选择权，还体现在选择权背后的无形教育成本，包括可量化的经济成本以及不可量化的其他成本，如就近入学权利的丧失。我国在新世纪初实行的农村中小学布局调整体现了国家和政府对规模经济效益的追求，也体现了农村对高质量的基础教育的需求，也是教育均衡发展的有效路径。但是，布局调整确实伤害了农村边远地区儿童的就近入学权，这和我国的法律体系有所冲突。唯有回归乡土，重振乡村教育，农村教育优先发展才是我国教育问题的根本解决路径，也就是“使每一个孩子就近入学”.

| Abstract: | The right to education is citizen＇s basic rights, including equality of education opportunity. In the compulsory education stage, the equality of education opportunity is not only embodied in the choice of education opportunities, but also reflected in the option behind the intangible cost of education, including quantifiable economic costs and the costs that cannot be quantified, such as the loss of right for entrance to the nearest school. At the beginning of the new century, the layout adjustment of rural primary and secondary schools embodies the pursuit of the efficiency of scaled economy by the State and the governments, it also reflected the rural demand for high quality basic education, and it is the effective path of balanced development of education. However, the layout adjustment has indeed violated the rights of children in remote regions for their entrance to the nearest schools, to some extent conflicting China＇s legal system. Only by regression to the local, by revitalization of rural education, and by priority to the development of rural education, can it be the fundamental solution to the problem of China＇s education, i. e., ＂to enable each child the right for entrance to the nearest school＂. |
