| 摘 要： | 我国法律没有规定离婚协议的效力。实践中,登记离婚前以及判决离婚后离婚协议的效力争议最多。文章认为,登记离婚前协议未生效,判决离婚之后协议是生效的。《婚姻法》解释三的出台,解决了登记离婚前离婚协议的效力问题,但是没能解决判决离婚后法律效力问题。建议仿照2011年实施的《人民调解法》的立法模式,建立离婚协议效力司法确认程序,促进利于纠纷的解决。

| Abstract: | Our country not required by law the validity of the divorce agreement.Registration before a divorce judgment after the divorce and the effectiveness of the divorce agreement in accordance with the decision whether divorce agreement division of property.however,The interpretation Ⅲ of marriage law solve the divorce registration before the effectiveness of the divorce agreement,but can’t solve problems after divorce judgment legal effect.Inorder to settle disputes,we suggest imitate the Judicial confirmation procedure in People’s Mediation Law in 2011 to set up the Divorce agreement judicial confirmation procedure. |
