| 摘 要： | 国家主权原则是国际法的基本原则,人权国际保护与尊重国家主权的关系在国际法上一直是一个争论颇大的问题。随着全球化的发展,人权的国际属性日益凸现,西方一些学者认为,人权问题已经超出国界成为国际问题,人权保护没有国界,人权高于国家主权。因此,我认为有必要重新认识二者之间对立统一的辩证关系,探索正确对待人权与主权的方法。

| Abstract: | The national sovereignty principle is a basic principle in international law,and it’s relation with the human rights international protection in the international law has been an question of large argument.Along with the globalization development,the human rights international attribute appears obvious day by day.Some western scholars believe that the human rights question has already surpassed the national boundary to become an international issue,and the human rights protection does not have the national boundary,so the human rights should be higher than the national sovereignty.Therefore,we should reconsider the dialectical relations of the two opposites’unification,and explore the correct method of treating human rights and the sovereignty. |
