| 摘 要： | 最高人民法院《适用（中华人民共和国婚姻法）若干问题的解释（三）》的出台，引起了社会的广泛关注和学界的普遍讨论，其中第四条规定的“在夫妻婚姻关系存续期间，因某些特殊情形或某些重大理由可以进行财产分割”的规定，打破了人们传统的“同财共居”的观念。婚内析产的概念及特征亟待深入细致的探讨和研究，婚内析产制度的理论基础需要从理论方面寻找依据。此外，有关婚内析产制度与分别财产制、非常财产制和离婚财产分割衔接的制度设计亦有进一步厘清的必要。

On the Connotation and Perfection of Property Division during the Existence of Marriage |

| Abstract: | ＂Explanations on the Application of Marriage Law Ⅲ＂ published by the supreme people court has aroused wide public concern and heated academic discussion. According to the fourth item, during the existence of marriage, in some special situations or for some important reasons, property could be divided, which breaks the traditional idea of ＂living together and sharing property＂. In this paper, the concept and features of property division during the existence of marriage is discussed in depth, and the theoretical basis of such division is analyzed. Moreover, how to connect marital property system with respective property system, special property system and divorced property division is also explored. |
