| 摘 要： | 对我国犯罪成立理论的致命缺陷的不同认识决定了对其进行完善的不同进路。与大陆法系犯罪成立理论体系相比,我国的理论体系具有“平面解释性”特点。这一固有的属性决定了我国犯罪成立理论的功能性缺陷,而其中最为致命的缺陷在于“形式与实质的平面融合”所带来的人权保障隐患。
