| 摘 要： | 惩治官吏职务犯罪是汉代法律中的重要内容,汉律不仅沿用了秦律中官吏职务犯罪的罪名,而且又增加了许多新的罪名。汉律中的官吏职务犯罪可以分为一般职务犯罪和特殊职务犯罪两大类,一般职务犯罪包括贪污贿赂、玩忽职守（失职）、越权及滥用职权、徇私舞弊等,特殊职务犯罪包括司法和军事领域的职务犯罪。汉律中的官吏职务犯罪的罪名大部分被《唐律》所沿用。

| Abstract: | Punishing the official crimes by taking advantage of one＇s duty was an important concern in the law of the Hart Dynasty. The law of the Han Dynasty not only continued to adopt many charges in relation to official crimes enforced in the Qin Dynasty, but also created many new charges. The official crimes by taking advantage of duty in the Han Dynasty ean be divided into two categories： general and specific. General crime by taking advantage of duty consisted of eorruption and bribery, dereliction of duty, as well as transgressing and abusing assigned duty. Specific crimes by taking advantage of duty included judicial malfeasance and military malfeasance. Many charges of official crimes by taking advantage of duty in the law of Han Dynasty were used in the Tang Code. |
