| 摘 要： | 中世纪末随着资本主义商品经济的发展、城市的兴起,欧洲出现了市民阶层,其特有的自由、平等、人格独立、权力等理念使得市民社会作为一个独立的领域与政治国家相互分离和互动发展,从而催生了宪政要素的产生,最终使得宪政国家在英美法等西方国家建立起来。市民社会不仅产生了与宪政相辅相成的政治文化,孕育了法律至上性理念,同时也为这种宪政理念的实现提供了制度性保障。因此,宪政的实现离不开市民社会的培育和成熟。

| Abstract: | At the end of the middle ages,with the development of the capitalism economy and the starting of cities there appeared citizen stratum,characterized by the belief,such as freedom,equality,power,personality independence,which made the separation and the interactive development of civil society as an independent field with country.So these fac-tors fostered the constitutional basic and made constitutional state set up in western countries such as British,USA,France,etc.Civil society is the real foundation and source of constitutional government.Civil society not only produced the political culture which complemented one another with the constitutional government,cultivated the concept of the supremacy of law,but also offered the institutional guarantee for the realization of the idea of the constitutional state.Hence,the constitutional government is closely correlated to the cultivation and ripeness of civil society. |
