| 摘 要： | 《民办教育促进法》及其《实施条例》的颁布实施,标志着我国民办教育进入了依法治教的新阶段。《民办教育促进法》和《实施条例》确立了办教育制度方面的重大原则:强调其公益属性,同时允许出资人取得合理回报,确立法人财产权,细化民办学校的准入、退出制度,完善法人治理机制等。这些重要的制度规定将对今后民办教育的发展产生深远影响,但同时也给完善民办教育的管理和政策体系提出了一系列新的课题。

| Abstract: | The promulgation and enforcement of the Promotion Law of Private Education of the People's Republic of China and the Implementation Rules under the Promotion Law of Private Education of the People's Republic of China marks the new development phase of privation education in China. The two laws have established such important principles for developing private education in China as allowing the investor to have reasonable benefit on the prerequisite of emphasis on the nature of public welfare, confirming the legal person's property right, specifying the mechanism of entry and exit of private schools and optimizing the mechanism for legal person's governing over private education. No doubt, these important principles will have far-reaching significance for the development of private education in the future. At the same time, they will also pose new challenges to the optimization of the management system of private education and policy system. |
