| 摘 要： | 预防司法要求司法追求纠纷解决的彻底性并积极发挥规则形成功能，立法应促进和便利人民使用公证制度，拓展其运行空间。中国司法实践中调解优先的司法政策为预防司法的生动体现。调解在解决纠纷的彻底性和修复当事人受损关系以抑制潜在纠纷方面具有制度优势，高度契和预防司法的追求。

| Abstract: | The judicial activism stresses the social function of the justice. To promote the citizens＇ welfare, the function of modern justice should be extended to prevent disputes actively without being confined to resolve disputes. The preventative justice is a systematic project, which requires that the civil procedure should pursue a thorough settlement of the dispute and play an active role in the function of the rule formation. It also requires the popularization of legal language and the opening of the verdict to the society to make the people understand the contents of the law and live by law. The legislation should promote and facilitate the people＇s use of notarization to expand its running space, so that the notarization can play a full role to make the rights and obligations clear, to prevent disputes from happening, and to reduce the cost of the dispute settlement. The priority of the mediation, a judicial policy in practice which emphasizes the pursuit of social goals, becomes an active form of the preventative justice. The mediation accords with the preventative justice because of its institutional superiority in solving the dispute thoroughly and repairing the damaged relations between the parties to restrain potential disputes. |
