| 摘 要： | 无效婚姻制度是我国修订后的《婚姻法》新增设的一项制度,它填补了我国婚姻立法的一个空白,是对我国婚姻立法的重大发展,也是我国婚姻法制建设的一大进步。它不仅完善了我国婚姻法理论,有利于婚姻法向民法典的回归,而且为人民法院审理违法婚姻案件提供了审判依据。但是,新婚姻法对于无效婚姻制度立法方面的设计还存在一些缺陷,所以对无效婚姻制度的内容、无效婚姻的确认、无效婚姻的法律后果进行深入的剖析,对于当前的司法实践及其婚姻立法相关内容的完善有着很强的现实意义。

| Abstract: | The invalid marriage system of China is a new rule added to the revised Marriage Law. It fills in the blank in the marriage legislation of China.As a great development and also a major progress in the construction of the marriage legislation system, the invalid marriage system not only improves the theory of the marriage law, and is also conducive for the return of the marriage law to civil code.h also provides trial basis for the people＇s court to deal with illegal marriage cases. However, there are still some defects in the new marriage law for the legislation of invalid marriage system. Therefore, a thorough analysis of invalid marriage system in respect of content, confirmation, and legal consequences will be of great realistic significance for the current judicial practice and legislative improvement. |
