| 摘 要： | 中国和蒙古国对被害人的保护在刑事实体法和刑事程序法方面都有很大差异，应当借鉴蒙古国先进的立法经验，从实体法和程序法角度确立被害人的知情权和上诉权，并进一步完善被害人的自诉权，从而构建我国的被害人权利保护机制。

| Abstract: | There are much difference of the protection of victims in the criminal substantive law and the criminal procedural law between China and Mongolia. we should learn advanced legislative experience from Mongolia to establish both the perspective of the victim＇s right to know and the right to appeal from the substantive law and procedural law, and further improve right of private prosecution so as to Construct our country＇s victim rights safeguard mechanism. |
