| 摘 要： | 传统理论对合伙人资格作了诸多限制：精神病人、未成年人和法人不能成为合伙人；家庭成员之间不能互为合伙人；一个合伙人不能同时成为其他合伙的合伙人等。这些限制在现代民法理论中都是不必要的，凡民事主体皆可成为合伙人。

| Abstract: | The qualitications of copartners are confined by the traditionat theory in many ways: Neither mental incompetent and minor norjuridical person can be partner; members of one family cannot be copartners: one partner cannot be the partner of other partnership at the same time. According to the theory of modcrn civil law. the above confinement is unnecessary and evwry civil law subject can be a partner. |
