| 摘 要： | 目的/意义]迎合大数据时代发展潮流,应是图书馆迭代升级的基本方向。随着大数据产业的兴起,我国陆续修改现行法规或颁布新规定,对网络安全、个人信息保护及网络运行中的数据安全等领域加强规范。但是,数据的权利归属等基础问题尚属法律空白,而该问题关系到图书馆如何因应大数据发展潮流和防范大数据开发利用风险,是迫切需要图书馆人深入思考和研究的重大议题。方法/过程]将图书馆大数据进行了原始数据和衍生数据的二层次界分:图书馆用户对原始数据拥有初始权利,可排除他人使用;图书馆合法收集的用户原始数据通过资产化、价值化形成的衍生数据,虽然其权属认定和权利范围相关法律法规尚未明确,但这部分数据归属于实现数据价值增值的主体即图书馆所有,符合财产性权利产生的法理基础和逻辑。结果/结论]迈向大数据时代的图书馆,应从运营管理智能化、打破信息孤岛以及精准服务三个方面搭乘大数据发展的"快车",充分发挥大数据获取、分析技术的作用,把握大数据发展潮流的因应之道。为防范图书馆大数据利用侵犯用户隐私、个人信息以及数据歧视的风险,从图书馆层面、用户层面、行业协会层面以及外部合作层面,提出了从内而外多维度化解大数据开发利用风险的破解之道。

Library Towards the Big Data Era: Right Differentiation,Coping Methods and Risk Dissolving |

| Abstract: | Purpose/significance]Meet the era of big data trends should be the basic direction of libraries in iterative upgrade.With the rise of big data industry,China has revised existing laws or promulgated new regulations successively,strengthening standards in the field of network security,personal information protection and data security in network operation.However,the basic legal issues such as the ownership of data are still a legal blank,which concerns how libraries adapt to the development of big data trends and prevent data using risks,requiring in-depth studies.Method/process]This paper divides library big data into two levels:original data and derived data:library users have the initial right to the original data and may exclude others from using it;as to the derived data that produces through capitalization and valuation of original data legally collected by library,although relevant laws and regulations on the ownership and scope of right have not been clarified,this part of data belongs to library that realizes data value increment,this is in line with the legal basis and logic of property rights.Result/conclusion]The library moving towards the era of big data should take the "express train" of big data from three aspects:intelligent operation and management,breaking the information island and accurate service,giving full play to the role of big data acquisition and analysis technology and handling the trend of big data development.In order to prevent the use of big data in libraries from infringing users’ privacy and personal information as well as the risk of data discrimination,the paper proposes a multi-dimensional solution to solve the risk from the level of libraries,users,industry association and external cooperation. |
