| 摘 要： | 所谓休息权的法律属性,是指休息权问题应当由哪个法律部门来进行规范。休息权是自然人得以生存和发展的基本权利,属于基本人权的范围。同时,在现代社会,休息权也是劳动者应当享有的与劳动权密切相关的一项基本权利。此外,它还是自然人人格权必要的和基本的组成部分,是一项独立的人格权。

| Abstract: | The legal attribution of the right to rest refers to the right to be standardized by which legal sector.The right to rest is the basic right for existence and development of natural person which belongs to the scope of human rights.Meanwhile,it is also the essential part of personality rights of natural person as well as a right to an independent personality.Moreover,in modern society,the right to rest is a fundamental right of workers closely relate with the right to work. |
