| 摘 要： | ＂赔命价＂作为藏族法律规范的重要内容长期存在,影响深远。随着社会的发展,＂赔命价＂也悄然发生了较大的变化。特别是近几年来,不经司法机关裁决,私下索要、调处命价、血价的现象日趋突出并呈上升趋势。其赔偿内容呈现多样化,不但涉及杀人、伤害等刑事案件,还包括了离婚、草山纠纷以及其他民事、经济案件的调处。其范围之广、内容之多、数额之巨,令人深思,已成为影响藏区社会治安稳定的隐患之一。本文主要以青海藏区的＂赔命价＂（本文所指的＂赔命价＂是广义的,包括＂赔血价＂）习惯做法为研讨对象,通过典型案例对其存在的问题进行了探讨分析。

| Abstract: | Over the years,intentional injury occurred in Tibetan areas of Qinghai,Grassy disputes involving personal injury and property damages compensation of violations in accordance with national legal standards are often often unable to mediat according to the law,but mostly by the upper class clan presided over by religious custom mediation.This will deal with the formation of violations of law in conflict with the clan customs.The author aims to explore the main form of expression,and the countermeasures. |
