| 摘 要： | 美国在保留死刑的同时,又采取严格措施对其予以限制,期间经历了一个漫长的过程。联邦最高法院根据"演进中的正当行为标准",通过对宪法修正案第八条"禁止残酷与不寻常之刑罚"和第十四条正当程序条款的不断解释,对死刑加以逐步限制。这种渐进式的死刑限制方式考虑到了社会客观现实,易于为民众接受。当死刑被极少适用时,将其予以废除就水到渠成了。这就为中国的死刑制度改革提供了有益的启示。

| Abstract: | The USA sustains the death penalty while taking strict measures to restrict it. According to the evolvement of decency,the Federal Supreme Court kelps explain constantly the cruel and unusual penalty clause prescribed by the Eighth Amendment and the due process clause prescribed by the Fourteenth Amendment of the Constitution,restricting the death penalty gradually.
