| 摘 要： | 中国的环境责任保险制度一直难以完全建立,追究其根源,是由其薄弱的法律基础所致。明确环境责任保险制度的承保模式、承保机构、保险责任等问题应当作为研究的重点。受国外相关制度的启发,我国应当尽力构建以强制环境责任保险为主、任意环境责任保险为辅,环境责任保险同特别基金相结合的法律制度。

| Abstract: | It has always been difficult to build the environmental liability insurance system due to the weak legal basis.Therefore,to explicit the insurance patterns,insurance undertakers and insurance liability of the environmental liability insurance system should be the key point of the research.Inspired by the concerned system in foreign countries,China should endeavor to establish a legal system which attaches most importance to the compulsory environmental liability insurance and takes nonrequired liability insurance as supplement with the combination of the environment insurance and special fund. |
