| 摘 要： | 在日趋激烈的市场竞争中，侵害商业秘密的行为相当普遍。既严重损害商业秘密权利人的合法权益，又扰乱了社会主义市场经济秩序，破坏了公平竞争的法律环境。探讨商业秘密的概念、商业秘密的法律特征、商业秘密的法律保护及存在的问题，目的在于唤起人们保护商业秘密的法律意识。

| Abstract: | As the market competions are intensifying the infringement of commercial secrecy has become a widespread pracice. It not only hurts the right of the commercial secrecy holder, but also disrupts the order of socialistic market economy. Also it damage the fairness of legal enviroment. This article deals with the definition, the legal character and the legal protection of commenerial secrecy, aiming to arouse the people's consciousness on protection of commerial secrecy. |
