| 摘 要： | 我国政府与公立大学是一种委托代理关系,而赋予大学治理者权力的边界却是一种“契约不完全”代理,正是政府决定的高等教育体制、大学内部管理体制等多种委托关系的不完全性,党政权力边界交叉显著且责权利的不对称性,从而滋生了“寻租”、机会主义和“败德”行为。监督机构的设置属于“自我监督”行为,难免要增加社会成本又难见成效,切实从制度框架变革委托代理关系乃势在必行。

| Abstract: | The relation between our government and public universities is commissioned and acting,while the government giving the university governance right border is an "incomplete contracts" agency.It breeds the "rentseeking",opportunism and immorality precisely because the incomplete of commissioned relations between higher education institutions and the university of the internal management system decided by the government and significant cross-border power between party and government and also asymmetries of responsibilities and rights.The set up of monitoring bodies is "self-monitoring".This inevitably increases social costs and achieves no results.It's imperative that the commissioned and acting relationship is changed from the institutional framework. |
