| 摘 要： | 当前农村农用土地的三权分离,土地使用权的流转没有国家法律的保障,带来许多现实问题,必须用法律确保农用土地的流转。要健全法律条文,落实所有权的主体,把现存农用地的三权并为二权,让农民真正拥有土地使用权,并严格规制政府的征地权,使土地流转健康运行。

| Abstract: | Promoting circulation of land in rural area is a necessary demand of planning the development between city and rural area.The division of three rights on rural land and no law's guarantees on circulation of rural land have brought many problems.The circulation needs new laws to assure it run successfully.It requires complementing the laws,confirming the ownership of land and combining three rights on land into two to let peasants truly have land's property.The land's recruiting by government must be restricted to let circulation running healthily. |
