| 摘 要： | 当前,考试作弊现象愈演愈烈,对作弊学生的处分也越来越严重,但忽视了对作弊大学生的法律保护。处分是手段而不是目的,加强高校管理的宗旨是为了培养具有健全人格、创新精神、实践能力的各种专门人才,而不是对学生动辄采取诸如开除学籍等严厉处分,处理作弊考生时应予以法律保护。

| Abstract: | Nowadays, cheating on examinations is becoming more and more striking, while the punishment on students involved in cheating is becoming increasingly severe, and the legal protection on these students has been ignored. Punishment is just the measure, but not the goal. The ultimate guideline to strengthen the college management is to cultivate all kinds of special talents with all-round personalities, innovative spirits and practice capacities, but not to punish the students severely with expelling as an example. It is very necessary to implement legal protection while punishing the students involved in cheating on examinations. |
