| 摘 要： | 在现实生活中经常会出现无授权之代理的情况,从法律后果来看,无授权之代理既有可能发生代理无效的后果,也有可能发生代理有效的后果.对于前者,大陆法系理论界通称为狭义的无权代理,即不发生属于有效代理的法律后果;对于后者,则称为表见代理,表见代理即被称视为有代理权之代理,将发生与有权代理一样的法律后果.表见代理作为一项重要的民事法律制度,在解决代理关系是否构成、代理责任如何承担的纷争方面发挥着重要的作用.本文试从表见代理的沿革,理论基础,遗留争论等方面进行探讨.

| Abstract: | In the reality often occurs unauthorized agency.The legal consequence of unauthorized agency has both no effect agency and effect agency.For the former,continental law system takes it as unauthorized agency,that's,which can't generate the consequence of effect agency;For the latter,continental law system names it as agency by estoppels regarded as the agency of authorized agency.Agency by estoppels as significant civil law system plays an important role in solving the disputes of agency liability and the agency relation founded or not. |
