| 摘 要： | 长期以来 ,刑讯逼供是一个影响公安队伍建设和严格执法的比较突出的问题 ,虽然我国刑法规定了刑讯逼供罪 ,刑事诉讼法也严禁刑讯逼供 ,但在实践中 ,刑讯逼供在某些地方依然时有发生。其主要原因包括 :封建专制主义刑事司法传统的影响尚未肃清 ;重打击犯罪 ,轻保障人权的观念根深蒂固 ;对严禁刑讯逼供的重要性认识不足 ;特权思想严重 ;监督机制的滞后与乏力。强调对刑讯逼供的防范要坚持德治与法治并重的方针。

| Abstract: | For long time,extorting a confession by torture is a serious problem that affects the construction of public security troops and carrying out laws strictly.Although China criminal law formalates the charge of inquisition by torture,the code of criminal procedure also forbids to extort a confession by torture,in practice,extorting a confession by torture somtimes happens. The mainly reasons include:the tradition of feudalism criminal law has not been eliminated;the idea that strong measures are taken against crime,and the human rights are not seriously guaranteed is rooted deeply;we don't pay special attention to the importance of forbiding to extort a confession by torture;the special privilege mentality is very serious;supervisory system is not completely for med.This paper emphasizes the policy that we must use the method that the rule of virtue is as important as the rule of law to keep a lookout at extorting a confession by torture. |
