| 摘 要： | 介绍了有关情事变更原则的几种学说，分析了情事变更原则的适用条件和范围，指出适用情事变更原则客观上必须有情事的变更，主观上情事的变更须未被合同当事人所预料，并进而指出情事变更与不可抗力和商业风险的区别。最后重点阐述了我国新的合同法确立情事变更原则的必要性。

| Abstract: | The paper introduces several theories on the princeples of circumstance alteration,analyses suitable conditions and limits of circumstance alterable principles, indicaes the principles apply only to the situation,where circumstance aleration does arise objectively and go beyond expectation of the contracting parties subjectively,and then proceeds to indicate the difference between circumstance alteration and iresistible force and commericial risk.It finally expounds the necessity of establishing the principles of circumstance alteration in national new law of contract. |
