| 摘 要： | “智力活动的规则和方法”不授予专利权,将智力活动与物质生产活动割裂开来,与专利法宗旨冲突,导致专利结构严重畸形,不能保护工序发明,不利于提升产业整体技术水平。专利法修订应取消“智力活动的规则和方法”款项,对工业领域的一切发明平等保护,激励工序创新,降低资源消耗和生产成本,增强企业产品的竞争力。

| Abstract: | That the regulations and methods of intelligent activities not patented,separating them from production,stands against the spirit of patent law,therefore leading to the serious deformity of patent structure,protecting not the working procedure,favouring not the whole elevation of producing technology level.The amendment of patent law ought to blot out the article of "regulations and method of intelligent activities",protecting all inventions in the industrial line;encourging to make new about working procedure,decreasing energy and capital costs,enhancing the competing ability of productions. |
