| 摘 要： | 自1983年以来,我国已开展多次“严打”斗争。不可否认,从重从快严厉打击严重刑事犯罪分子能使社会治安形势得到一定程度的好转。但是,“严打”中所暴露的问题也迫使我们必须在理论上进行探讨研究,如此,才能正确认识“严打”,也才能正确贯彻运用“严打”。“严打”之“从重”必须坚持罪刑均衡原则,只有依法从重,使刑罚与犯罪分子的罪行相适应,才能正确执行“严打”刑事政策,才能实现刑法之保护社会与保障人权的双重机能。
