| 摘 要： | 对认定内幕交易究竟是应以“利用”内幕信息还是以“知悉”内幕信息为标准这个问题，可以借鉴在认定内幕交易的其他经验，采“知悉”为标准，适用举证责任倒置，如此才能有效而方便地认定内幕交易。
