| 摘 要： | 人性预设是制度设计的根本前提，性善与性恶两种人性预设导致了中西方德治与法治不同的政治文化与制度安排。从人性出发，德治与法治在制度设计上都存在着不足，德治与法治的价值互补使二者的结合具备了制度安排的合理性。激励机制的建立是德治在实践层面得以实施的基础。也是德治与法治有机结合的制度中介。
