| 摘 要： | 我国高职教育虽在理念上形成了工学结合人才培养模式,但保障该模式顺利推行的制度建设则相对落后,尤其是保障工学结合模式顺利实现的法律制度更是缺失,未能成为推动社会产业、经济以及教育本身发展的强有力的内在动力。目前,应从职业教育发展所遭遇的现实困境以及法律困境入手,积极探寻并构建我国实现工学结合人才培养模式的法律制度体系,这种法律制度的构建应当以经济的发展为驱动,政府在其中起重要的引导作用,法律体系的内容应当包括高职教育法律法规的制定与完善、工学结合模式主体权利与义务的规定、高职教育的执法监督等内容。
