| 摘 要： | 党的十八届四中全会提出优化司法职权配置,推动实行审判权和执行权相分离的体制改革试点,最高人民法院设立巡回法庭,探索设立跨行政区划的人民法院和人民检察院,探索建立检察机关提起公益诉讼制度。建立最高人民法院的巡回法院,是符合中国国情、合理调整审判权分配的一项重要举措,对于我国实现司法独立与保障人权有着重要意义。

| Abstract: | The Fourth Plenary Session of the 18 th CPC Central Committee discussed the allocation of judicial authority, the promotion of the experiment of judicial authority and executive authority＇s separation. The establishment of circuit courts is a signifi cant measurement to the adjustment of judicial authority, which is signifi cant for the judicial independence and protection of human rights in China. |
