| 摘 要： | 传统的讲究“客观真实”的证明标准在环境侵权诉讼中使因果关系认定存在困难，应借鉴国外因果关系推定理论，在立法上完善我国环境侵权民事责任因果关系证明制度，根据环境侵权案件的类型选用相应的因果关系推定方法，建立独立、科学的鉴定机构和数据库资料系统。

| Abstract: | It is difficult to cognize the causation in environmental tort action because objective reality is emphasized in traditional criterion.In China foreign theory of causation presumption should be referred to improve causation institution related to civil responsibility of environmental torts,correlative presumption method should be selected based on different types of environmental tort,besides independent scientific identification organizations and database systems be constructed. |
