| 摘 要： | 迁徙自由作为公民的一项基本人权已经获得了国际社会的普遍认同,许多国家将其作为公民基本权利在宪法中明确予以规定和保障。我国已经加入了WTO,先后签署了两个国际人权公约。对此我们应重新理解迁徙自由的涵义,结合我国国情,我们应在创立有利的社会环境、法制环境、通过寻求公民迁徙自由权的法权基础从而在宪法中确立公民迁徙自由权,同时建立相应的救济制度,以真正实现我国公民迁徙自由权的宪法保障。

| Abstract: | As a basic human right of citizen free migration has got universal recognition in the world.It is regarded as a basic right and is under the protection of constitution in many count.Since China has entered WTO and has signed successively two international convention of human right we should have a new understanding of the connotation of free migration.According to the situation of China we should establish citizens' right of free migration in constitution and at the same time establish the corresponding relief system so as to enable citizens' right of free migration to be really protected by the constitution. |
