| 摘 要： | 宪法理论界通常认为我国没有宪法解释案例，也无违宪审查的实践。1982年宪法以前宪法解释与违宪审查的案例表明，宪法的实施，不可避免地需要宪法解释与违宪审查制度。而已有的案例以经验事实表明，宪法解释与违宪审查制度具有被动性、非授权性、先例性、非制度性、随机性与客观性。研究和分析这些案例包含的宪法解释与违宪审查原理，对于建立与完善我国的宪法解释与违宪审查制度，具有积极的理论与现实价值。

| Abstract: | The constitutional theory circle generally holds that in China there is no constitutional interpretation case or review practice of constitutionality, the casesof which before the 1982 constitution reveal that the implementation of constitution in China inevitably needs such a system. The empirical fact of the casesshows that the system is passive, unauthorized, precedented, non-systematic, atrandom and objective. Study and analysis of constitutional interpretation andreview principle of constitutionality are of positive theoretical and realistic value in the establishment and improvement of the system in China. |
