| 摘 要： | 董必武是新中国第一代马克思主义法学家,他科学系统地阐述了中国宪政语境下党法、党政关系,对中国宪政的内在特有品格给予了科学的界定,并亲身进行了一系列开拓性的探索与实践。他所倡导的"依法办事"、"党政职能分开"思想,为我党过去和现在正确处理和规范党法、党政关系指明了方向,具有开创意义。

| Abstract: | As a first generation expert of Marxist laws in new China,Dong Biwu scientifically explained the relationship between the party and law and that between the party and the government in the context of China constitutionalism.In addition,he scientifically defined the inner character of China constitutionalism and carried out by person a series of investigations and practices.The ideas of "handling affairs according to law" and "the separation of the functions of the party from those of the government" advocated by him showed clearly a direction for our party either in the past or at present in correctly handling and standardizing the relationship between the party and law and that between the party and the government,which is of innovative significance. |
