| 摘 要： | 职务犯罪的日益严重，已成为困扰世界各国的一个共同难题，为了惩治和预防该类犯罪，各国刑法都相继建立了一系列相关的法律制度和措施，通过中外刑法在职务犯罪主体、职务犯罪的种类和职务犯罪的惩罚措施等一系列问题上的立法比较，可以取长补短，进一步完善我国刑事立法。
