| 摘 要： | 用拾得的信用卡在ATM机上取款的行为时有发生,刑法理论与司法实践中对这种行为的定性均存在不同的理解。笔者拟借助刑法理论对其进行分析,认为用拾得的信用卡在ATM机上取款的行为不能成立侵占罪,也不构成盗窃罪,应当属于诈骗罪。同时,基于信用卡诈骗罪与诈骗罪的关系是特殊法条与一般法条的关系,应当认定为信用卡诈骗罪。

| Abstract: | The act of drawing cash from ATM with a picked-up credit card occurs from time to time,while the criminal law and justice have different understanding on the act.The author analyzes the act on the basis of the criminal law and thinks the act of drawing cash from ATM with a picked-up credit card is not the crime of encroachment and theft and should be the crime of fraud.Meanwhile,because the relationship between the credit card fraud and the crime of fraud is the relationship between special legal items and general legal items,the act should be the credit card fraud. |
