| 摘 要： | 相对旧时无限政府的现代有限政府，是依宪法设立并代表国家在宪法、法律规定的职权范围内行使国家行政权，组织、管理国家行政事务的机关。现代有限政府行政自由裁量权的状态表现为行政功能增加，行政领域扩大，扩张与限制矛盾交织，这给行政法治赋予了新的含义，行政法治不是消除广泛的行政自由裁量权，而是应当控制其泛滥。有限政府应是没有利益的中立者，应有所为而有所不为，应在法制规则的范围内行使自由裁量权。

| Abstract: | In contrast with the past unlimited governments, the limited-authority governments, set up according to the constitutions and representing the countries, implement, organize and manage the administrative affairs of their countries within the limit of authority regulated by the constitutions and laws. The state of free-ruling right of Administration in limited governments shows that the functions of administration increase, the areas of administration expand and the expansion and the limitation contradict each other, which give ruling by law in administration a new concept: ruling by law in administration is not the elimination of free-ruling right, but to control the abuse. The limited governments should be the neutral ones without benefits, doing what they are obliged to do and implementing the free-ruling right according to the regulations by law. |
