| 摘 要： | 被劳教人员张斌之死,让劳动教养制度成为继收容遣送制度被废后又一备受关注的问题,法学界和实务界就该项制度的存废展开热烈讨论。不管结果如何,现行劳动教养制度存在严重的缺陷已是不争的事实。而2004年两会上全国人大常委会将《违法行为矫治法》列入五年立法规划则意味着劳动教养制度必须进行重大变革。本文试从我国劳动教养制度的现状及制度中存在的缺陷入手,分析我国劳动教养制度的出路和发展方向。

| Abstract: | ZHANG Bin's death makes the system of reeducation through labor a question of wide concern and,no doubt,there are serious defects in the system.So significant reforms or changes are absolutely necessary.The paper points the defects and analyzes the ways out and development trends. |
