| 摘 要： | 随着19世纪西方民主、科学思想的渐进,我国的法制现代化也已悄然起步,虽有过彷徨但却成为一种不可逆转的趋势。然而,受到民族法律文化的影响,中国法制发展的近两百年间,虽然法学理论日益精进、法律制度日趋完善,但在实践中这些理论和制度的实施仍然存在某些矛盾和阻碍。故而应从法律文化的角度分析这些矛盾与阻碍及其产生的最深刻的原因,并从容地选择我国法制现代化发展的模式。

| Abstract: | With the progress of western democracy and scientific thought in the 19th century,the legal modernization in our country has also started quietly,and it has become an irreversible trend though once there was some wandering.However,during the last two hun-dred years of China＇s legal development,affected by the national legal culture,though the legal theory has increasingly sophisticated and the legal system has being maturing,there still exists some contradiction and obstruction when they are implemented.Therefore,it is nec-essary to analyze these contradiction and obstruction and the cause of them from the point of legal culture,and choose the development mode of our legal modernization calmly. |
